PRIVACY POLICY

This policy sets out the basis on which Bytech (together with our subsidiaries, affiliates, our holding company, subsidiaries of our holding company from time to time, collectively called "Bytech" or “We”) collects personal data from you and how we process such data.

 

By visiting our website (our “Site”) or using our Channel Data Management services (our “Services”) or using any of our applications or software (our “Apps”) we offer as a service provider for our Business Customers (our "Customer") from time to time, you accept and consent to the practices set out below.

1. PROCESSING OF INFORMATION 

Bytech may process Personal Data in the role of a processor or service provider on behalf of our Customer (Data Controller) on its documented instructions and for the purposes agreed in this DPA, unless required to do so by applicable law. We do not process Sensitive Personal Data. In processing any personal data on behalf of our Customers, we aim to ensure the following data processing principles are complied with:
a. Lawfulness, Fairness and Transperancy - This is required to be confirmed by our Customer / the Data Controller. We will be clear, open and honest about what personal data we process, and will only handle data in ways that is reasonably expected within the context of the Controller's requirements.
b. Purpose Limitation & Data Minimization - We limit the processing of personal information for only the purposes specified by the Data Controller.
c. Storage Limitation - We only retain Personal Data for as long as necessary to fulfill the processing purposes based on our Customer's documented instructions and for the end-purposes agreed. On termination of the contract with the Data Controler, we will delete or destroy all Personal Data, unless retention is required by law
d. Integrity & Confidentiality - We have implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risks presented by Processing Personal Data, in particular from accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access. We shall take reasonable steps to ensure all staff who have access to Personal Data are committed to keeping it confidential.

2. COLLECTION OF INFORMATION

We may collect and process the following information about you:

 

Information you give us - information that you provide us (which may include your name, address, email address, telephone number, by filling in forms on our Site or our Apps, or by corresponding with us (by phone, email or otherwise), for example:

a. when you report any problem to us;

b. when you use certain feature on our Site or our App;

c. when you request any support from us; or

d. when you complete any survey or questionnaire, we send you.


Information we collect about you - information automatically collected when you visit our Site or use our Apps, for example:

a. technical information, including the Internet protocol (IP) address used to connect your computer to the Internet and your log-in information, browser type and version, time zone setting, browser plug-in types and versions, operating system, and platform.

b. information about your visit, including the full Uniform Resource Locators (URLs), clickstream to, through and from our site (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number.

We only retain personal data for so long as it is necessary. Data may be archived as long as the purpose for which the data was used still exists.

3. USES MADE OF THE INFORMATION 

We use information held about you for the following purposes:

a. providing, improving and developing our services to our Customers.

b. presenting content and information in our Site and our App in the most effective manner for you and for the device you use.

c. providing you with alerts, updates, materials or information about our services or other types of information that you requested or signed up to.

d. complying with laws and regulations applicable to us in countries that we operate. 

e. responding or taking part in legal proceedings, including seeking professional advice.

f. communicating with you and responding to your questions or requests; and

g. purposes directly related or incidental to the above.

4. DISCLOSURE OF YOUR INFORMATION 

We will keep your personal data we hold confidential, but you agree we may provide information to:

 

a. any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries.

b. personnel, agents, advisers, auditors, contractors and service providers in connection with our operations or services.

c. our overseas offices, affiliates, and counterparts (on a need-to-know basis only).

d. persons under a duty of confidentiality to us.

e. persons to whom we are required to make disclosure under applicable laws and regulations in regions that we provide our services.

5. SHARING OF INFORMATION WITH THIRD PARTIES 

As a matter of policy, any personal information that we collect or process will not be shared or disclosed to third parties (whether for their marketing purposes or otherwise) without your consent. However, we reserve the right to disclose your personal information as required in the normal course and scope of our business in the provision of our services to our customers, and where required by applicable law, statute, regulatory or governmental order or court order.

6. COOKIES 

We may use data collection devices such as “cookies” on certain pages of the Website to promote trust and security, help analyse our web page flow and measure promotional effectiveness. “Cookies” are small files placed on your hard drive that assist us in providing our services. We may offer features that are only available through the use of a “cookie”. We also use cookies to reduce the number of times you need to enter your password. 

Cookies can also help us provide to you information that is targeted to your interests. Most cookies are “session cookies”, meaning that they are automatically deleted from your hard drive at the end of a session. You are always free to decline our cookies (if your browser permits you to do so), although in that case you may not be able to use certain features on the Website and you may be required to enter your password more frequently during a session on the Website.

Some of our business partners (for example, advertisers) may use cookies on our Website or their own websites. We have no access to or control over these cookies. You are not obliged to accept a cookie from us, or any other website, and you may modify your browser so that it will not accept cookies, although some features on the Website may not function if you do.

7. THIRD-PARTY SITES

Our Site, our App, our Services or our communication with you may from time to time contain links to third-party websites over which we have no control. If you follow a link to any of these websites, please note that they have their own practices and policies. We encourage you to read the privacy policies or statements of these websites understand your rights. We accept no responsibility or liability for any practices of third-party websites.

 

8. SECURITY

All information you provide to us is stored on our secure servers. 

Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Site or App, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

We review our information collection, storage and processing practices from time to time to guard against unauthorised access, processing or use. 

Please note, however, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Site; any transmission is at your own risk.

 

9. YOUR RIGHTS

You have the right to: 

a. check whether we hold personal data about you.

b. access any personal data we hold about you.

c. require us to correct any inaccuracy or error in any personal data we hold about you. 

Any request under this Clause 9 may be subject to a small administrative fee to meet our cost in processing your request.

10. CHANGES TO OUR PRIVACY POLICY

We may amend this policy from time to time by posting the updated policy on our Site. By continuing to use our Site, our App and our Services after the changes come into effect means that you agree to be bound by the revised policy.
